What You Will Be Doing

Albertsons Companies is seeking an experienced and highly motivated Litigation Counsel to join its Legal Department. This attorney will have significant responsibility for managing a broad and sophisticated litigation docket and advising business leaders across the company on litigation risk.

The Litigation Counsel will develop and execute litigation strategy for matters involving Albertsons’ grocery business, fuel centers, and pharmacies. The successful candidate will take ownership of matters from inception through resolution, work closely with business partners and other members of the Legal Department, and bring a practical, strategic, and trial-focused approach to disputes.

The role includes responsibility for a wide variety of litigation, investigations, administrative proceedings, subpoenas, and government requests. We are looking for a lawyer who exercises excellent judgment, enjoys solving difficult problems, is intellectually curious, and is comfortable taking an active, hands-on role in significant matters and quickly learning new areas of law and business. 
 

Main responsibilities:

• Develop and execute litigation strategy for assigned matters, including evaluating risk, identifying strategic options, and recommending practical solutions.
• Take ownership of litigation matters from initial assessment through discovery, motions, mediation, trial, appeal, or other resolution.
• Actively manage and partner with outside counsel, including setting strategy, evaluating work product, staffing matters appropriately, and managing litigation efficiently and cost-effectively.
• Advise business leaders and Legal Department colleagues regarding litigation risk, potential disputes, and strategies to prevent or mitigate litigation.
• Coordinate and prepare company witnesses for depositions, hearings, investigations, and trials.
• Respond to third-party subpoenas, government requests for information and documents, and other legal process.
• Conduct and manage internal and external investigations, including matters involving government agencies and regulators.
• Work closely with the eDiscovery Team on document preservation, collection, review, production, and other discovery matters.
• Draft, review, and provide strategic input on briefs, motions, discovery responses, settlement agreements, and other significant litigation materials. 

 

We are looking for candidates who possess the following:

• Juris Doctor (JD) from an accredited U.S. law school.
• Active membership in good standing in at least one U.S. state bar and eligibility to practice as in-house counsel in the applicable jurisdiction.
• 5 plus years of meaningful litigation experience at a law firm, in-house legal department, government agency, or a combination thereof.
• Strong hands-on litigation experience in federal or state courts, which may include discovery, depositions, motion practice, legal research, brief writing, mediation, arbitration, pretrial proceedings, or trial preparation.
• Experience independently managing litigation matters and making strategic recommendations regarding case strategy, risk, and resolution.
• Demonstrated ability to counsel business clients on litigation and legal risk in a practical, commercially focused manner.
• Excellent judgment and analytical, strategic, writing, negotiation, advocacy, and communication skills.
• Intellectual curiosity and the ability and willingness to quickly learn new areas of law, business operations, and emerging legal risks.
• Ability to manage multiple significant matters and competing priorities in a fast-paced environment.
• Experience managing outside counsel and litigation budgets. 

 

Preferred Qualifications 

• Meaningful practical experience including depositions, hearings and trial support.  
• Experience conducting or advising on internal or government investigations or interacting with federal or state regulatory or law-enforcement agencies.
• Experience with one or more areas of complex litigation, such as commercial or contract disputes, consumer class actions, intellectual property disputes, regulatory matters, or other significant business litigation.
• Experience managing large-scale discovery and eDiscovery matters.
